Terms & Conditions
These terms are the basis of the contract between you as the customer and Kelly’s Cakes bishop Auckland. We consider these Terms, and your order confirmation are the agreement between you and us for the sale of cakes.
It is your responsibility to check all details in the order confirmation are complete and accurate as this is the document I use completing your order.
CAKE ORDERING
Any example pictures, sketches, or descriptions on the order are issued solely to provide you with an approximate idea of the cakes they describe
Quotations are valid for a period of 14 calendar days from the day of issue.
Cake sizes quoted are in inches and are approximate only
Your booking will only be confirmed once a deposit is paid. Once your booking fee has been received you are in a legally binding contract with Kellys Cakes Bishop Auckland.
Kelly’s Cakes warrant that on collection the cakes shall conform to their description as set out in the order confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. Kelly’s Cakes will not be held responsible for customer disappointment of the design or the interpretation of the cake as long as it is made in line with the customer’s pre agreed requirements set out in the order confirmation and will face no consequent liability. It is the customers responsibility to ensure all details within the order confirmation are correct and meet their requirements before a deposit has been made.
The warranty does not apply to any defect in the cakes arising from wilful damage, accident, negligence by you or any third party, if you use the cake in a way we do not recommend, your failure to follow our instructions or any alterations you carry out. Kelly’s Cakes Bishop Auckland cannot be held responsible after the cake has left the property. If any problems should occur, You must contact me within an hour of collection. If I am able to, I can offer to change / repair if it is negligence on my part. But I have made that many cakes I make sure each and every cake is fully supported for transportation. There is no reason why it should not get from A to B unless there has been accidental damage. By not following instructions given.
If someone is collecting the cake on your behalf, you must ensure they have a copy of all the collection information so they know how to fully transport the cake safely. All cakes are photographed before leaving my kitchen, also a picture will be on your care sheet you get with your cake
Occasionally certain materials for cakes may become obsolete. This is totally out of my control; however, i will do my best to select replacement products to reflect the original design as closely as possible. I reserve the right to replace items with parts of equal or better quality without consultation. As items can be hand made and different products used, exact colour matches can not be guaranteed but will be as close as possible.
If your cake contains figures made from sugar paste, whilst edible, we do not advise that they be eaten, due to the possible presence of dowels for reinforcement.
Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption.
The cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Cakes should be stored in a cool, dry place, at room temperature, away from direct sunlight and sources of heat in the box provided.
They should NOT be refrigerated, unless it is very hot and your cake is going to melt and it will be taken out and used straight away before condensation may appear, then sliced and left to go soft again, as they fridge can make the cake harder until it goes back too room temp again, as fondant covered cakes and where edible images have been used can cause the sugar paste to sweat and colours run after being in the fridge if condensation forms
ALLERGEN INFORMATION
Allergies must be stated before Ordering As my kitchen is not an allergy free kitchen. Your cake is baked in a kitchen that handles allergens and food tolerances. I take the health and safety of my customers as a priority I feel it is of paramount importance to let all my customers know my position on allergies and food intolerances. My business is from home, I am registered with my local council ( 5-star rating). I cannot guarantee that my cakes are suitable for those with allergies or intolerance’s, due to a high risk of cross contamination in my multi-ingredient kitchen. For this reason and the new laws regarding allergens, I do not cater for any food intolerances or allergies, regardless of how minor these may be. Please ensure any guests consuming my cakes are aware that my cakes do contain cereals containing Gluten, Eggs, Milk, and may contain nuts and peanuts. At present I do not offer, Vegan, Vegetarian, Dairy free, Gluten free, or allergy free cakes.
Our cakes are made in an environment where nuts, egg, milk, gluten and other allergens are present. We cannot guarantee that any cake is entirely allergen free. Full list can be found on my website just type in kellyhymas.wixsite.com/kellyscakes
CLEANING & REGISTRATION
I have a 5* star hygiene rating: I adhere to all cleaning regulations Everything is cleaned, washed, and sanitised before, after and during each task. All equipment & food areas used are cleaned and disinfected, including doors, floors, oven, and all the kitchen area. I Clean as I go between tasks. All cleaning chemicals and Disinfection products meet the BS EN 1276 or BS EN 13697 standards. My hygiene certificates are in my album on my business Facebook page.
PRICE AND PAYMENT
The price of your cake will be as set out in your order confirmation. A deposit is required to secure all orders. Please note all deposits are non-refundable and will be deducted from the final price of the collected order. Any unique materials required for your design and needed to be bought by Kelly’s Cakes, in the event of cancelation by you, will need to be paid for in full. The balance must be paid for when you collect your cake on the day.
CANCELLATION & POSTPONEMENT
Deposit paid are non-refundable. If for any reason you fail to collect your cake order, we reserve the right to take action to recover any balances outstanding. Once deposit has been paid – Personalise toppers are made / ordered.
In the event of a cancellation by yourselves, the following applies: Deposit is Non refundable at any time

Less than 7 days – Deposit are Non refundable – Date is non transferable, any costs Kelly’s Cakes has occurred will be payable by the customer

7-14 days’ notice- Deposit is Non – Refundable, but you may be able to transfer your original cake to another date But any personalised items made would need to be used on this design. There maybe a surcharge to accommodate new changes to the original design. This is at the discretion only. Depending on how much work has already been completed on your cake already.

14-21 days notice – Deposit non – refundable but you may be able to transfer the cake design to another date or if work has not started change, deco or design however if anything personalised has been done there may be a surcharge to accommodate remaking and designing of these items. Or any purchased items.

21 days plus notice – Deposit non refundable – but you can transfer the cake or design to another date available. However if any personalised work has been done there may be a surcharge to accommodate remaking and designing of these items. Or any purchased items.
IF I NEED TO CANCEL
Rest assured that in the unlikely event that i must cancel your order for any reason, such as illness, family passing or any unforeseen circumstances, that I will always try to give you as much notice as possible. But please understand that in some circumstances this may not always be possible.
You can choose to have a full refund on all money paid. Or transfer the deposit to a cake later in the year. I have never had to cancel any order to date. It would be only in extreme circumstances would I ever need to.
COLLECTION
HANDLING YOUR CAKE
Place both hands under the box to distribute the weight evenly when carrying the box. Be careful at the sides where there could be decorations close to the board as it may damage your cake. Do not carry it close to your chest as it will push the sides of the box in and be on a slant. The corrugated cake boards can flex and bend if not fully supported causing the cake to torque, leaving cracks in the cake. Be careful to ensure the cake is always flat even when travelling.
TRANSPORTING

Make sure you have adequate transport with plenty of space, clean, and free from debris. Travel with the air con on in the car.

Don’t Move the cake too much too much movement can weaken the cake structure.

Make sure your cake is suitably placed in your car, The cake must be completely flat, the footwell for smaller cakes & the boot is ideal for larger cakes, some cake boxes can be up to 20 inch wide & very tall. DO NOT place the cake on your seats or your knee these are uneven and all it takes is a few degrees of slope or sharp breaking for an accident to occur.

Nonslip mats are ideal to place under your cake, also pack clean towels around the cake box to stop the box from sliding in the boot.

Drive slowly & carefully to reduce the risk of damage, turn the heating off and use the air con. Every little bump and break effects the solidity of your cake.

Cakes must be collected on the specific date you booked. Collection times are emailed to you a few days before collection you must reply to this email to confirm. Collections must be within my collection times.

All cakes are photographed before leaving my kitchen, also a picture will be on your care sheet you get with your cake. I accept no liability for cakes that have been damaged once the cake has left my property. It is up to the person collecting and handling your cake to transport it safely. Please check your cake upon collection. Any issues must be raised upon collection or within an hour of taking your cake away. After this time, it may not be possible to rectify any problems.

All cakes are boxed suitable for travelling. Please ensure if you are travelling with your cake in your car that you have air con turned on. The cake box must be completely flat. Do not travel with cakes on the seat or on knees. They are not flat. The best place for smaller cakes is on the floor in the front seat foot well. For larger cakes place in the boot on a non-slip mat padded with pillows around it to stop it from moving or sliding if necessary

I am not responsible for uneven ground in venues, so please ensure the cake is in a safe, dry stable position out of sunlight or hot overhead lights.
STORAGE
NEVER put your cake in the fridge, unless stated. Store your cake in the box provided in a cool dry place away from lights, drafts, heat & strong odours. Once cut store cake in a cool area inside the box it was provided in wrapped in cling film or foil. . You may slice unused cake wrapped in foil / clin film in an air tight container in the fridge and let it come to room temperature around 2 hours before serving.
SHELF LIFE
Your cake is always at its best consumed on the day of your event and is made to use on that day. The cake is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day.
I do not guarantee freshness after the event date that you put down on your booking form and should be consumed within a reasonable time scale.
Cupcakes are best consumed the day you collect and for freshness after this they may become drier in texture and taste.
Take care when displaying your cake avoid direct sunlight, spotlights, candles, and heat sources that may damage or spoil your cake.
MY CAKE IS DIFFERENT WHY?
Any cake ordered from a picture or photo of a cake produced by any other cake maker can only be reproduced as my interpretation and not an exact copy.

I will not be held responsible for customer disappointment of the design or the interpretation of the cake if it is made in line with the customer’s pre-agreed requirements set out in the order confirmation and will face no consequent liability. It is the customer’s responsibility to ensure all details within the order confirmation are correct and meet their requirements.
As with all things in life some things do not go to plan. Sometimes the character will not stand on the top of the cake, sometimes what you want to do just will not do it. Sometimes there may be small changes to your cake when you collect it.
Colour matching, I will do my best to match a colour as close as we I deem possible. Exact colour matches are not guaranteed.
CAKE PORTIONING / SERVINGS
All customers slice cakes differently. I can only estimate a suitable size for your requirements, there is a cutting guide on the back of your cake care sheet to help. I cannot be held responsible for not being able to cut the number of slices out that you need. Please order the size that suits you. Google searches give so many different cutting guides and portion sizes that I always leave this to the customer to decide on the size of the cake they require
NON-EDIBLE ITEMS
Beware of small edible sugar pearls these can be very hard on your teeth and supervise children who are consuming the cake with pearls. Ensure you read the care sheet which will notify you of any non-edible items on your cake. Food safe sticks are used on cake toppers and to hold figures together.
Stacked cakes contain dowels in each tier to provide support and these should be removed before consumption. Never push a person’s face into a cake as there may be dowels inside your cake. Always inform me If this is the type of cake you are wanting so we can make it safe. Also inform the venue of anything non- edible on your cake. Figures (unless otherwise stated) are for decoration purpose only. All designs and intellectual property rights remain the property of Kelly’s Cakes. We reserve the right to use images/videos of your cake for any form of advertising including web-based promotions, brochures, galleries and competitions.
